4. Hosting and Infrastructure

Our website and our SaaS platform are hosted on servers in Germany. We rely on data centers that are ISO 27001 certified and meet the highest standards in terms of physical security, uptime, and data protection.

Hosting provider: The servers are located in German data centers. No transfer of personal data to third countries takes place.

Legal basis: Legitimate interests (Art. 6(1)(f) GDPR). Our legitimate interest lies in the secure and efficient provision of our website and our service.

5. SSL/TLS Encryption

This site uses SSL/TLS encryption for security reasons and to protect the transmission of confidential content, such as inquiries that you send to us as the site operator. 9. Registration and Customer Account (SaaS Platform)

Registration is required to use our SaaS platform AutoPult. During registration, we collect the following data:

  • First name and last name
  • Email address
  • Company data (name, address, VAT ID)
  • Phone number
  • Password (stored encrypted)

Legal basis: Performance of a contract (Art. 6(1)(b) GDPR). The data is necessary for the establishment and execution of the contractual relationship.

Storage period: Customer account data is stored for the duration of the contractual relationship. After termination of the contract, the data is deleted after the expiry of the statutory retention periods (generally 6 or 10 years pursuant to the German Commercial Code (HGB) and the German Fiscal Code (AO)).

10. Newsletter

With your consent, you can subscribe to our newsletter, through which we inform you about current news, product updates, and industry-relevant information.

Registration: For newsletter registration, we use the so-called double opt-in procedure. This means that after your registration, we will send you an email to the specified email address asking you to confirm that you wish to receive the newsletter.

Data collected: Email address, time of registration, IP address, confirmation time.

Legal basis: Consent (Art. 6(1)(a) GDPR).

Where we engage service providers for data processing, we have concluded data processing agreements pursuant to Art. 28 GDPR with them to ensure the protection of your data. Your data is only disclosed for the purposes described below and to the extent permitted by law.

14. Data Processing in the Context of SaaS Usage

In the context of using our SaaS platform, we process the data you enter (e.g., vehicle data, customer data, invoice data) exclusively on your behalf and according to your instructions. In this case, you are the controller within the meaning of the GDPR, and we act as the data processor.

The details of the data processing are set out in our Data Processing Agreement (DPA), which you receive upon conclusion of the contract.

15. Rights of Data Subjects

As a data subject, you have the following rights under the GDPR:

15.1 Right of Access (Art. 15 GDPR)

You have the right to obtain confirmation as to whether personal data concerning you is being processed by us. If this is the case, you have a right of access to this personal data and to further information as set out in Art. 15 GDPR.

15.2 Right to Rectification (Art. 16 GDPR)

You have the right to request the immediate rectification of inaccurate personal data and, where applicable, the completion of incomplete data.

15.3 Right to Erasure (Art. 17 GDPR)

You have the right to request the immediate erasure of your personal data, provided that one of the grounds set out in Art. 17 GDPR applies, e.g., when the data is no longer needed for its original purpose.

15.4 Right to Restriction of Processing (Art. 18 GDPR)

You have the right to request the restriction of processing if one of the conditions set out in Art. 18 GDPR applies, e.g., if you contest the accuracy of the data.

15.5 Right to Data Portability (Art. 20 GDPR)

You have the right to receive the personal data concerning you, which you have provided to us, in a structured, commonly used, and machine-readable format. You also have the right to transmit this data to another controller.

16. Right to Object (Art. 21 GDPR)

You have the right to object, on grounds relating to your particular situation, at any time to processing of personal data concerning you which is based on Art. 6(1)(e) or (f) GDPR. This also applies to profiling based on those provisions.

Where personal data is processed for direct marketing purposes, you have the right to object at any time to processing of personal data concerning you for such marketing purposes; this also applies to profiling to the extent that it is related to such direct marketing.
